Terms and Conditions
The agreement between you and Blooms Point Flower Arrangement Services when you place an order on this site. Written to be read before you order rather than after.
- Effective date
- Last updated
These are the terms on which we sell flowers and gifts through this website. They are written to be read by the person buying, not only by a lawyer — so where a clause has a practical consequence, it says what it is. If anything here is unclear, ask us before you order and we will explain it.
1. Who we are
Blooms Point Gifts and Flower Shop is the trading name of Blooms Point Flower Arrangement Services, a florist and gift business operating in the Philippines. When these terms say “we”, “us” or “our”, they mean Blooms Point Flower Arrangement Services, and that is the party you are contracting with when you place an order on this site.
- Registered address: Barangay Lucsuhin, Silang, Cavite, Philippines
- Email: inquiries@bloomspointph.com
- Telephone: +63 935 856 1320
- Support hours: 7:00 AM–10:00 PM, daily
Our shops each have their own address and opening hours, which are listed on the branches page. The address above is the registered address of the business, not a shop counter.
2. About these terms
These terms govern your use of this website and every order you place on it. By browsing the site or placing an order you accept them. Please read them before you order rather than after — they are written to be readable, and they say things you would want to know in advance.
Three other documents form part of this agreement and should be read with it:
- our Return and Refund Policy, which sets out when we replace, refund or cancel;
- our Dispute Resolution Policy, which sets out how to complain and what happens next;
- our Privacy Policy, which explains how we handle personal data.
The delivery information, the substitution policy and the freshness guarantee also form part of these terms. They carry the operational detail — windows, cut-offs, what may be substituted, what condition flowers should arrive in — and they are written to be read before you order.
We may change these terms. The version published on this page at the time you place an order is the version that governs that order, and changing them later does not change an order you have already placed. The effective date and the date of the last update are shown at the top of this page.
3. Using this website and your account
You may use this site to browse, to place orders, and to manage orders you have placed. To place an order you must be able to enter into a binding contract under Philippine law and be ordering for yourself or for someone you are authorised to order on behalf of. This site is not directed at children, and we do not knowingly sell to them.
You do not need an account to order — guest checkout is the ordinary path and an order can be tracked with its order number and the email address on it. If you do create an account:
- give us accurate details, and keep them up to date;
- keep your password to yourself, and tell us promptly at inquiries@bloomspointph.com if you think someone else has it or has used your account;
- you are responsible for what is done through your account, unless it was used without your knowledge and you told us as soon as you became aware.
You can close your account at any time by asking us. Closing it does not delete order records we are required to keep — our Privacy Policy explains why.
4. Products, photographs and natural variation
The photographs show a real arrangement of that name, built by us. Flowers are a natural product: the exact shade, the number of open blooms and the precise shape vary a little between one bouquet and the next, and screens render colour differently. That variation is normal and is described in section 3 of our Return and Refund Policy.
Where a product name or description states a stem count, that count is exact — a bouquet described as twenty-four roses arrives with twenty-four roses. Where a size is described in words, it describes the overall arrangement rather than any individual stem.
We take care to describe and price products accurately. If we discover a material error in the description or the price of something you have ordered, we will contact you before we accept the order and you may confirm it at the corrected price or cancel it for a full refund.
5. Availability and substitutions
Cut flowers are bought at market, hours before they are arranged, and stems sell out. Where a particular flower, wrap, container, colour or seasonal material is unavailable, we may substitute — within limits we publish and hold ourselves to.
We keep the overall size, the value, the colour palette, the flower type wherever it exists at all, the stem count where the name states one, and the container, wrap and ribbon shown in the photograph. Where the change is one you would notice, we contact you before we build anything; for funeral and sympathy work we call you whatever the size of the change, and we never substitute the form of a funeral piece. The full rules are in the substitution policy.
6. Prices, taxes and delivery charges
All prices are shown in Philippine pesos. The price shown for a product is the price you pay for it, inclusive of any tax that applies to that sale; where any tax is charged separately it is shown before you confirm the order, and your order summary always shows the total you are agreeing to.
Delivery is charged per order and is shown at checkout before you confirm. There is no free-delivery threshold and no minimum order value. Where you are entitled to a refund because an order was faulty, undelivered or materially late through our fault, the delivery charge is refunded with it.
Prices can change, but never for an order already accepted. The price that applies to your order is the price shown when you placed it.
7. Placing an order, and when a contract is made
Placing an order is an offer to buy. The contract between us is made when we send you the confirmation email with your order number — not when the checkout finishes. That confirmation, and the order record behind it, are electronic documents and have legal effect as such under the Electronic Commerce Act of 2000 (Republic Act No. 8792).
We may decline an order, and if we do we will tell you why and refund anything paid. In practice it means one of three things: we cannot deliver to that address on that day, the arrangement cannot be built in the time available, or the card message asks us to write something unlawful, abusive or threatening. In the last case we will call you before we cancel anything.
Please check your confirmation email when it arrives. If anything on it is wrong — the date, the address, the message, the items — tell us straight away and we will correct it.
8. Payment
You choose a payment method at checkout: Cash on Delivery, e-wallet, card, or bank transfer.
- Cash on Delivery. You pay the rider the order total on delivery. Please have the amount ready where you can; riders carry limited change.
- E-wallet, card and bank transfer. We contact you with the details and your reference number. An order is prepared once payment is arranged.
If a payment we are waiting on has not arrived by the cut-off for your delivery, we contact you rather than cancel. We will never ask you for your PIN, your online banking password, or a one-time password — not by email, not by phone, and not in a chat message. If anyone asks you for those in our name, it is not us.
If we add an online payment method in future, payment will be taken by that provider in its own secure form and these terms will apply to it in the same way.
9. Delivery
Delivery windows, cut-off times, delivery areas and same-day eligibility are set out in full on the delivery information page and form part of these terms. Metro Manila is served by our own riders; provincial orders go by courier and are never same-day.
We deliver to the address you give us, so please check it. Where a delivery fails because the address was wrong or incomplete, or the contact number does not reach anyone, we will contact you to arrange another attempt, and a redelivery to a corrected address may be chargeable — we will tell you the amount before we make it.
If the recipient is not there, our rider looks for someone who can receive on their behalf and we tell you who signed. If there is genuinely nobody, the flowers come back to the studio and a second attempt is agreed with you rather than charged automatically.
Traffic, weather and road closures affect deliveries in Metro Manila and we cannot legislate for them; a rider running late inside a busy day is not a fault. An order that arrives on the wrong day, or too late for the occasion it was bought for, is — and our Return and Refund Policy says what you are owed.
Risk in an order passes to you, or to the recipient, when it is handed over at the delivery address. Until then it is ours.
10. Changes, cancellations and refunds
The detail is in our Return and Refund Policy, which governs. In summary:
- You can change the delivery date, the address, the window or the card message, or cancel for a full refund, up to the cut-off for the day the order is booked on.
- After the cut-off the arrangement is being made to order from perishable stems for one delivery, so a cancellation for change of mind may not be possible. Ask anyway — if we can still make the change, we will.
- Where an order arrives damaged, defective, wrong, short, incomplete, or does not arrive at all, you are entitled to a replacement, a re-delivery, or a refund in full or in part. That applies regardless of the cut-off.
- An approved refund is returned by the route you paid, and we start it promptly — normally on the working day we agree it. How long it then takes depends on the bank, wallet or payment provider involved.
11. Gift orders, card messages and recipients
Most orders on this site are gifts, so you will usually be giving us someone else’s name, address and telephone number. By giving them to us you confirm that you are entitled to share those details for the purpose of this delivery. We use them to deliver and for nothing else: a recipient is never added to a mailing list and never contacted about anything but their delivery. Our Privacy Policy explains this in full.
Your card message is written out by hand by a florist. Keep it lawful and civil — we will not write something unlawful, abusive or threatening, and section 7 explains what happens if we are asked to.
Where a delivery is a surprise, give us the recipient’s number rather than yours; the rider calls ahead as they approach and will not say who the flowers are from before the card is opened.
12. Promotions and discount codes
From time to time we run promotions or issue discount codes. Unless the promotion says otherwise: one code per order; codes cannot be exchanged for cash; they apply to product prices rather than delivery charges; and they must be applied at checkout, because we cannot apply one to an order that has already been placed.
Where an order paid with a discount code is refunded, the refund is of the amount you actually paid. Where only part of an order is refunded, any discount is apportioned across the order.
We may withdraw a promotion at any time, but not for an order already accepted under it.
13. How you may not use this site
Please do not:
- use the site for anything unlawful, or to send anything unlawful, abusive, threatening, harassing or deliberately false;
- place an order in someone else’s name without their authority, or with payment details you are not entitled to use;
- attempt to gain unauthorised access to the site, our systems, or another customer’s account or order;
- scrape, copy or systematically extract the site’s content, or use automated means to place orders or reserve stock;
- interfere with the site’s operation, or upload anything designed to damage it or its users.
We may suspend or close an account, and decline or cancel orders, where we reasonably believe this section has been breached. If we do, we will tell you why, and you can ask us to look again under our Dispute Resolution Policy.
14. Intellectual property
The content of this site — the photographs of our arrangements, the product and editorial writing, the Blooms Point Gifts and Flower Shop name, logo and branding, and the design of the site itself — belongs to us or is used with permission. You may look at it, share links to it, and print or save it for your own use in connection with an order.
You may not copy it for a commercial purpose, republish it as your own, or use our name or logo in a way that suggests we endorse or supply something we do not, without our written permission. If you would like to use one of our photographs, ask us at inquiries@bloomspointph.com — the answer is often yes.
If you think something on this site infringes your rights, tell us and we will look at it promptly.
15. Website availability and third-party services
We aim to keep the site available, but we do not promise it will be uninterrupted or error-free. We may suspend it for maintenance, and we may change or withdraw products, content or features. Where a fault on the site affects an order you have placed, that is our problem to fix, and section 10 and our Return and Refund Policy apply.
The site relies on services provided by others — hosting, email delivery, maps, and couriers for provincial deliveries — and it may link to sites we do not run. We are not responsible for the content of a site we do not control, and a link is not an endorsement. Where a third party is involved in fulfilling your order, our responsibility to you for that order is unchanged.
16. Our responsibility to you
Our responsibility is to supply what you ordered, in the condition described, on the date agreed — and to put it right when we do not. Where we fail, you are entitled to the remedies in our Return and Refund Policy and to any remedy Philippine law gives you.
We are responsible for loss that is a foreseeable result of our breaking this contract or failing to use reasonable care. We are not responsible for loss that was not foreseeable — for example, a business opportunity said to have been lost because a bouquet arrived late, where nothing about the order told us that was riding on it.
17. Events outside our control
Some things genuinely stop a delivery: a typhoon, a flood, an earthquake, a fire, a public emergency, a government order, a general strike, a failure of the power or telecommunications network, or a road closure that puts an address out of reach.
Where one of those prevents or delays an order, we will contact you as soon as we can and agree what to do — a new delivery date, a change of address, or a cancellation. If the order cannot be delivered at all, you get a full refund including delivery. We do not treat an event outside our control as a reason to keep your money.
18. Complaints, governing law and disputes
If something goes wrong, please tell us at inquiries@bloomspointph.com. Our Dispute Resolution Policy sets out how we handle complaints, how long it takes, and what you can do if we have not resolved it — including the internal redress mechanism required by section 24 of the Internet Transactions Act of 2023, which is treated as exhausted if a complaint is still unresolved 7 calendar days after it was filed.
These terms, and any dispute arising out of them or out of an order, are governed by the laws of the Republic of the Philippines. You may bring a claim in any Philippine court or before any agency that has jurisdiction under Philippine law, including where you live.
19. General
- If part of these terms cannot be enforced. If a court or agency finds any provision here invalid or unenforceable, the rest continues to apply, and the provision is read down to the extent needed to make it enforceable rather than struck out entirely.
- Delay is not waiver. If we do not insist on something straight away, or delay in enforcing a right, that does not mean we have given it up.
- Transfer. We may transfer our rights and obligations under these terms to another business, and we will tell you if we do; your rights under this agreement are not reduced by a transfer. You may not transfer your rights without our agreement, though anyone may of course order flowers for someone else.
- The whole agreement. These terms, together with the policies and pages named in section 2 and your order confirmation, are the agreement between us about your order.
- Language. These terms are written in English.
